GENERAL TERMS AND CONDITIONS OF SALE
Article I. PREAMBLE
To facilitate the reading of this document, the General Terms and Conditions of Sale will hereinafter be referred to as "T&C" throughout this document. Our activity of tourist accommodation rental, private group hosting, and wellness services is conducted professionally and constitutes our commercial activity. The S.A.S. MAS CANERS, hereinafter referred to as "Mas Caners" or "the establishment," is the company operating the proposed services and is identified as follows :

Article II. DESCRIPTION OF THE OFFER
Section 2.01
The commercial offer is presented
- on our website www.mascaners.com
- in a quote that we submit to you in writing following your explicit request (the descriptions in the provided quote then take precedence over the description on the website).
Section 2.02
Our rates and offers are subject to availability at the time of booking and may not be renewed for future reservations.
Section 2.03
The commercial offer consists of inseparable products. Your choice not to use one of them during your stay cannot, under any circumstances, justify a reduction in the price of the stay offer.
Section 2.04
The sale of our commercial offer complies with professional and commercial regulations in force in France.
Article III. PRICES
Section 3.01
The prices of the commercial offers displayed on www.mascaners.com, owned by Mas Caners, are considered contractual, except in cases where different conditions are exclusively confirmed in a quote following a client's request. In such cases, the details in the quote (offer description, prices, dates, and specific conditions) take precedence over the general terms displayed on the website www.mascaners.com.
Section 3.02
In all cases, conditions, prices, and offers are subject to change without prior notice (except for confirmed bookings or quotes that are still valid).
Section 3.03
Prices include VAT applicable at the time of ordering. Any change in VAT rate will be automatically reflected in the prices at the time of invoicing. Any modification or introduction of new legal or regulatory taxes imposed by the authorities will also be automatically reflected in the prices at the time of invoicing.
Section 3.04
Unless otherwise stated on the booking platform, additional services are not included in the price. Taxes (such as local taxes, tourist taxes, etc.), if applicable, as listed on the pricing page, must be paid directly on-site to the establishment.
Section 3.05
Night Entry to the Estate
Access to the gîtes LE PETIT CANERS and LE GRAND CANERS is available 24/7 exclusively for tenants during their rental period.
Article IV. ACCOMMODATION CAPACITY
Section 4.01
The reservation is made for a specific number of guests. The age of children must be provided at the time of booking. Under no circumstances may the number of guests accessing the rooms exceed the capacity of the reserved accommodation.
Section 4.02
If, upon arrival, the number of people exceeds the booked capacity, the owner may refuse to accommodate additional guests. This refusal cannot be considered a modification or termination of the contract by the owner. Therefore, if guests exceeding the allowed capacity decide to leave the establishment, no refund will be issued.
Article V. BOOKING TERMS
Section 5.01 : Payment Conditions
- The payment conditions are specified at the time of booking on the website www.mascaners.com or any other sales platform offering Mas Caners services.
- In the case of a quote, the payment conditions stated in the quote take precedence over any other conditions displayed on the website or sales networks.
Section 5.02: Booking Confirmation
Your booking is considered final only:
- After full payment of the total amount of your stay.
- If applicable, upon receipt of a dated and signed quote or purchase order, marked with “Approved” and sent to Mas Caners.
Section 5.03: Booking via Website or Phone
You can book your stay online at www.mascaners.com
The booking process follows these steps:
- The client selects the desired gîte, number of guests, and check-in date.
- The booking engine suggests available offers that match the client's criteria.
- The client selects services and options and adds them to the online cart.
- To validate the online cart, the client enters their full contact details, including the company name if applicable.
- The client must accept the General Terms and Conditions of Sale (T&C).
- The system requires a valid credit card (Mastercard, Visa, etc.) to charge the full stay amount to confirm the booking.
- Once the booking is validated, an automatic confirmation email is sent summarizing the reservation details.
Section 5.04
Entering the required banking information and accepting the GTC and booking request serves as an electronic signature, which is legally equivalent to a handwritten signature.
Digital records stored in the reservit.com system will be kept securely and considered proof of communications, bookings, and payments between the parties. The client is informed that their IP address is recorded at the time of booking.
Section 5.05
If the client does not wish to enter credit card details online, they must interrupt the online booking process and call +33 (0)7 67 50 70 45 to arrange an alternative booking method and payment of deposits if required.
Section 5.06
If a booking is made through an online travel agency, the present GTC fully apply for booking, deposit payment, confirmation, and stay registration.
Section 5.07
Payment of your stay implies your implicit acceptance of the General Terms and Conditions of Sale (t&c).
Section 5.08: Access to the Outdoor Spa :
Access to the swimming pond is self-service all year round (refer to the House Rules).
The Nordic bath and panoramic sauna are not self-service.

Three booking slots are available: 9:30 AM – 11:30 AM, 1:30 PM – 3:30 PM, 4:00 PM – 6:00 PM
The sauna and bath can accommodate up to six people.
Booking is done directly on www.mascaners.com
Bath towels and robes are provided free of charge.
Article VI. RIGHT OF WITHDRAWAL
In accordance with current regulations (Articles L.121-20-2 and L.121-20-4 of the French Commercial Code), the right of withdrawal does not apply to accommodation service contracts.
Article VII. MODIFICATION OF SERVICES BY THE CLIENT
Any change in date, identity, or number of guests cancels the existing reservation, which must be rebooked. You must submit a new request directly to Mas Caners, either by postal mail or by email at hello@mascaners.com.
This modification request will only take effect once SAS MAS CANERS has confirmed its acceptance via postal mail or email.
Article VIII. CANCELLATION OF THE STAY BY THE CLIENT
Section 8.01
Free cancellation is available on www.mascaners.com up to 30 days before arrival. For any cancellation or postponement made less than 30 days before arrival, regardless of the reason, the cancellation fee is 100% of the booking amount.
Section 8.02 : Booking Postponement
When requesting a cancellation, the client may request a one-time postponement to a new date within 3 months of the original cancellation date, subject to availability. In this case, no penalty applies: Deposits will be transferred to the new booking, minus a €25 administrative fee. If the client cancels their rescheduled stay, regardless of when they cancel, all previously paid deposits will be retained by Mas Caners. As such, the conditions outlined in Sections 8.03, 8.04, and 8.05 do not apply to a second postponement cancellation.
Section 8.03 : Cancellation Conditions
Deadlines and costs :
- The cancellation conditions are specified at the time of booking on www.mascaners.com or any other platform offering Mas Caners services.
- If a quote is provided, the cancellation conditions in the quote take precedence over those stated on the website or other sales networks.
Section 8.04
A cancellation request is only effective once Mas Caners has confirmed its approval via email.
Section 8.05
Gift Box or Gift Voucher Bookings :
- Gift boxes and vouchers are subject to the same rules as standard reservations.
- Validity: 12 months from the date of purchase.
- Applicable for a one-night stay for two adults, from Sunday to Thursday, excluding public holiday eves and public holidays at Mas Caners.
- Advance reservation required via www.mascaners.com, subject to availability.
- Gift boxes or vouchers: Can only be used once (non-divisible). Non-refundable.
- Cancellation or modification prior to the stay: Gift boxes and vouchers follow the same modification and cancellation rules as standard reservations.
Article IX. MODIFICATION OF STAY DURATION
Section 9.01
The client, as the signatory of this contract for a fixed duration, cannot claim any right to extend their stay unless explicitly agreed upon by Mas Caners, which reserves the right to charge additional fees for any extra services consumed.
Section 9.02
If the client leaves Mas Caners before the scheduled departure date, regardless of the stay’s duration, Mas Caners will charge the full amount of the reserved and confirmed services prior to arrival.
Section 9.03
Under no circumstances can the client claim any right to remain on the premises beyond the initial rental period, unless explicitly agreed upon by Mas Caners.
Article X. CANCELLATION INSURANCE
Mas Caners emphasizes that no cancellation insurance is included in its rates. It is therefore strongly recommended that you subscribe to cancellation insurance through an insurer of your choice. An optional cancellation insurance is available through SafeBooking. You can review the general terms and subscribe via our website: www.mascaners.com. If you did not opt for this insurance, cancellation is not possible.
Article XI. CANCELLATION OF STAY BY THE OWNER
Section 11.01
If Mas Caners must cancel the reservation before the stay begins, for any reason, the client will be immediately informed via any available means of communication provided at the time of booking, in a manner appropriate to the time available before the scheduled stay.
Section 11.02
Without prejudice to any claims for damages, any amounts already paid by the client will be fully refunded within a maximum of 8 days via check, credit card refund, or bank transfer.
Article XII. YOUR ARRIVAL
Section 12.01 : Check-in Time
Your check-in is available on the day of your arrival between 4:00 PM and 8:00 PMbut you will not be able to access your gîte before 4:00 PM. Exceptionally, late arrivals after 8:00 PM may be accepted, provided that Mas Caners is informed in advance. For your comfort and peace of mind, we kindly ask you to communicate your estimated arrival time in advance.
Section 12.02
In compliance with current regulations, clients may be required to complete a police registration form upon arrival. To verify whether this requirement applies, guests must present a valid ID at check-in.
Section 12.03 : Delay
In case of delay, please notify us by telephone at +33 (0)7 67 50 70 45. Unless expressly agreed otherwise, we will not be able to accommodate you after 8:00 p.m.
Section 12.04 : No-Show
If a client fails to arrive without providing advance notice of a delay (acknowledged by Mas Caners before 8:00 PM), the reservation will be considered void. A penalty fee of 100% of the booking amount will be charged. This policy takes precedence over any other condition, even if more favorable to the client.
Article XIII. SECURITY DEPOSIT
Section 13.01
Mas Caners requires a security deposit from the client to cover potential damages caused by the client or their group during their stay, or to settle any unpaid charges for services consumed before departure. The security deposit will be charged two days before your arrival.
Section 13.02
The deposit amount depends on the accommodation booked:
Le Petit Caners : €400
Le Grand Caners : €600
Le Domaine Caners : €1000
Section 13.03
The security deposit can be made through the following methods:
A credit card imprint will be taken via a payment terminal, without actually debiting the client's account. The terminal will process a pre-authorization request, generating a transaction reference number valid for one month. This pre-authorization temporarily blocks the specified amount on the client's account. The client must ensure that their credit card has sufficient funds to cover the pre-authorization amount, without exceeding their authorized spending limit. If the pre-authorization request is declined, the client must provide the security deposit in cash.
If the pre-authorization request via credit card is declined, the client must provide the security deposit via an instant bank transfer or a cash payment in euros.
Section 13.04
If the required security deposit is not provided upon arrival, the client will not be able to access the reserved services. In this case, the reservation will be canceled or postponed, without any compensation or indemnity from Mas Caners.
Section 13.05
The security deposit will be refunded within a maximum of 7 days from the client's departure. The refunded amount will match the initial deposit, and it will be fully reimbursed to the client's credit card, minus any deductions for unpaid charges, damages, or missing items identified by Mas Caners.
Article XIV. PROPERTY CONDITION REPORT
Section 14.01 : Check-In Property Inspection
Upon receiving the keys, the client has until 12:00 PM (noon) the day after arrival to report to Mas Caners any anomalies or malfunctions in the provided facilities and furnishings, particularly in private-use areas such as the Le Petit Caners and Le Grand Caners gîtes included in the reservation. If no issues are reported within this timeframe, both the client and Mas Caners will consider the property to be in perfect condition.
Article XV. DAMAGES CHARGEABLE TO CLIENTS
Section 15.01 : Tenant’s Obligation
Any damage caused by the contracting client or any member of their group must be fully reimbursed by the contracting client. Any damage observed by the client must be immediately reported to Mas Caners.
Section 15.02
Use of Security Deposit for Damage or Loss
The security deposit paid upon arrival will serve as the primary source of reimbursement for any damages.
If the damage costs exceed the deposit amount, the client agrees unconditionally to pay the remaining balance without delay.
If the damage costs are lower than the deposit amount, the difference will be refunded by Mas Caners within 7 days.
Section 15.03
Replacement or Repair Fees ;
The actual cost of replacement or repair applies, except for certain items that have a fixed replacement fee.
For lost or unreturned keys, a charge of 100€ per key applies.
For towels not returned upon departure, the charges are as follows
Hand towel, bath towel, or bath mat: 50€
Bathrobe: 150€
For bedding not returned upon departure:
Bedspread, duvet, or duvet cover: 300€
Pillow or pillowcase: 100€
For electronic equipment not returned or broken:
Television: 650€
Bluetooth speaker (Marshall): 450€
Remote controls (TV, pellet stove, lights): 100€
Bedside lamp: 100€
Cordless vacuum cleaner: 380€
Other small electrical appliances (excluding major kitchen or laundry appliances): 150€
For kitchenware not returned or broken:
Utensils such as knives, forks, spoons, strainers, peelers, glasses, placemats, dish towels, etc.: 15€ per item
Dishes such as plates, cups, serving dishes, coffee maker, jug, teapot, etc.: 25€ per item
Cooking equipment such as pans, pots, steam cookers, oven trays, microwave trays, etc.: 150€ per item
Food processor: 350€
Espresso machine: 350€
Electric griddle: 600€
Other kitchen appliances: 150€
For excessive cleaning required upon departure, a minimum fee of 150€ applies, plus any additional professional cleaning charges. This applies in cases such as dirt accumulation (sand, mud), stained bed linen or towels (with substances like nail polish, beauty products, blood, bodily fluids, vomit), stains on walls, ceilings, or furniture, and human or animal waste.
Article XVI. USE OF THE PARKING AREA
Section 16.01
Mas Caners provides a dedicated parking area for clients' vehicles, with a maximum capacity of 5 mid-sized cars.
Section 16.02
Mas Caners is not responsible for any damage, theft, or break-ins involving vehicles parked on the premises during the client’s stay.
Article XVII. PETS
Section 17.01
For hygiene reasons and to ensure a peaceful environment, pets are not allowed, except with explicit authorization from Mas Caners at the time of booking. The only exception is for service dogs assisting visually or physically impaired individuals.
Section 17.02
Failure to comply with this clause will result in the refusal of both the pet and its owner. This refusal does not constitute a contract modification or termination by Mas Caners. Therefore, if the client decides to leave, no refund will be granted.
Article XVIII. INTERNET ACCESS
Mas Caners provides WiFi access, allowing clients to connect to the internet. The client agrees not to use the IT resources made available by the establishment for copying, distributing, making available, or publicly sharing any copyrighted content without proper authorization. This includes texts, images, photographs, musical works, audiovisual works, software, and video games protected under Books I and II of the French Intellectual Property Code. Failure to comply with these obligations may constitute copyright infringement, as outlined in Article L.335-3 of the French Intellectual Property Code, and may result in penalties including a fine of €300,000 and up to three years in prison. Additionally, the client must adhere to the security policy of the internet service provider, including any measures implemented to prevent unlawful use of IT resources. The client must also refrain from any actions that compromise the effectiveness of these security measures.
Article XIX. CODE OF CONDUCT AND USE OF PREMISES
To ensure peace and comfort for all guests, the following rules apply:
(1) Smoking is strictly prohibited throughout Mas Caners, including electronic cigarettes, in both gîtes and common areas.
(2) Open flames (barbecues, candles, bonfires) are forbidden, and smoking outdoors is only allowed in designated safe areas.
(3) The only authorized cooking appliance is the electric plancha, which must be used outdoors, at least one meter away from any walls.
(4) Smoking is only permitted outside the property grounds.
(5) Late-night arrivals must be silent to respect the peace of other guests.
(6) Meals must be consumed in the living area, kitchen, or private terrace, and never in bedrooms.
(7) Clients must return the gîte in the same condition as received (excluding routine cleaning). Any damages must be reported and financially covered by the client.
(8) Private areas of the property are strictly off-limits to guests.
(9) Minors on the property remain under the full responsibility of their parents or guardians.
(10) Furniture, games, and equipment provided to guests must not be moved or used improperly.
(11) Mas Caners is not liable for loss, theft, damage, or injuries occurring on the property, regardless of the cause.
(12) Guests must remain courteous towards other clients, visitors, and property owners.
(13) Guests must inform Mas Caners in advance if they expect visitors during their stay.
(14) Only toilet paper provided by Mas Caners may be disposed of in the toilets.
(15) Towels provided by Mas Caners must not be used for makeup removal, shoe cleaning, or stained with beauty or polish products. Clients are responsible for replacing damaged linens.
(16) Forgotten items can be shipped upon request and at the client's expense.
(17) Subscribing to streaming services or web subscriptions other than those available on the TV is not allowed.
(18) Intoxication is strictly forbidden within the gîtes and common areas.
Article XX. CHECK-OUT
On the last day of your stay, check-out time is between 7:00 AM and 10:00 AM at the latest. After 10:00 AM, an additional night's stay or extra service fee will be charged.
Article XXI. PAYMENT OF THE BALANCE OF THE STAY AND SERVICES
Section 23.01
A final invoice will be provided at the end of your stay, including the total amount due for the stay and any additional services or consumptions not initially included in the reservation.
Section 23.02
As an individual client, the final invoice must be paid on the morning of departure using one of the following methods:
Credit card (Carte Bleue, Visa, Mastercard)
Cash (Euros only)
ANCV Holiday Vouchers (limited to 50% of the total TTC invoice amount)
Bank checks are not accepted.
Section 23.03
As a professional client, your final invoice will be issued upon departure and must be settled using one of the following methods:
Credit card before leaving the establishment
Bank transfer within 8 days following the completion of services
In accordance with Articles L. 441-3 and L. 441-6 of the French Commercial Code, a fixed late payment penalty of €40 will be applied in case of delayed payment.
Article XXII. RESPONSIBILITIES
Section 24.01
Any behavior contrary to public order or morality will result in the establishment requiring the client to leave immediately, without any compensation or refund, even if payment has already been made. The client accepts and agrees to comply with the Internal Regulations in force. Failure to adhere to any provision of these regulations will oblige the establishment to request the client’s departure, again without any compensation or refund, if payment has already been made.
Section 24.02
You certify that you are of legal age and covered by a Civil Liability Insurance policy that includes your own responsibility as well as that of your family members.
Section 24.03
Mas Caners certifies that it holds an insurance policy covering its Professional Civil Liability, arising from its tourist rental activities as described in the statutes of the S.A.S.
Section 24.04
The photographs displayed on our Reservit booking platform, our website www.mascaners.com, and partner websites are not contractually binding. Although every effort is made to ensure that the photographs, graphic representations, and descriptions accurately reflect the services offered, variations may occur between the time of booking and the actual stay.
Section 24.05
The establishment cannot be held liable for the non-performance or poor execution of a reservation in cases of force majeure, third-party actions, or the client's own actions. This includes situations such as internet network unavailability, website access issues, external intrusions, computer viruses, or unauthorized prepayment refusals by the client’s bank. Force majeure refers to any unforeseeable and insurmountable event beyond the control of the parties that prevents either the client or the establishment from fulfilling their contractual obligations. Events recognized as force majeure or fortuitous cases by French court jurisprudence fall under this category. Neither party shall be held liable to the other in the event of non-performance due to force majeure. It is expressly agreed that force majeure suspends the execution of reciprocal obligations, and each party shall bear the resulting costs independently.
Section 24.06
Any irregular, invalid, incomplete, or fraudulent reservation or payment attributable to the client will result in the cancellation of the booking at the client's expense, without prejudice to any potential civil or criminal legal action against them.
Section 24.07
Claims related to the non-performance or poor execution of reserved services must be submitted in writing within eight days after the departure date from the establishment. Failure to do so within this timeframe will result in the claim being inadmissible.
Article XXIII. DATA PROTECTION
Section 25.01
Mas Caners informs you that your contract/booking confirmation, deposit invoices, and final invoices contain certain personal data, which are recorded for the purpose of customer relationship management, particularly in the context of executing these General Terms and Conditions (C&T).
Section 25.02
You have the right to access, correct, or delete your personal data. These rights can be exercised by submitting a written and signed request to Mas Caners.
Article XXIV. FORCE MAJEURE
Force majeure refers to any external event beyond the control of the parties, which is both unpredictable and insurmountable, preventing either the client or the establishment from fulfilling all or part of their contractual obligations. Events considered as force majeure or unforeseen circumstances are those recognized by French court jurisprudence. Neither party shall be held liable to the other for the non-performance of their obligations due to a force majeure event. It is expressly agreed that force majeure suspends the execution of mutual obligations, and each party shall bear the costs resulting from such an event
Article XXV. DISPUTE RESOLUTION
In the event of a dispute, the client and Mas Caners will make every effort to resolve any disagreements amicably. This contract is governed by French law. Any disputes arising from this contract, including those related to its validity, interpretation, execution, termination, consequences, or outcomes, shall be submitted to the competent courts under common law jurisdiction.
Article XXVI. INTEGRALITY
Section 28.01
The following documents constitute the entire set of obligations between the parties and form the contractual commitments between them: the signed quote or the booking confirmation submitted through our online booking system at www.mascaners.com, including the specific conditions of the reserved rate, these General Terms and Conditions of Sale (T&C), and the Internal Regulations of the establishment.
Section 28.02
The act of booking commits the client and all members of their group to accept and fully comply with these General Terms and Conditions of Sale (T&C), the Internal Regulations, and any requests made by Mas Caners during their stay.
Section 28.03
No general or specific conditions communicated by the client may be incorporated into these General Terms and Conditions of Sale.
Section 28.04
In the event of a conflict between the booking confirmation or quote and the General Terms and Conditions of Sale (T&C), the provisions stated in the booking confirmation or quote shall prevail for the obligation in question.
Section 28.05
These General Terms and Conditions of Sale may be modified and/or supplemented by the establishment at any time. In such cases, the updated version of the GTC will be published online by the establishment. Once published online, the new version will automatically apply to all clients.
Article XXVII. HOUSE RULES OF THE ESTABLISHMENT
Section 29.01
The House Rules of the Establishment set out the rules and guidelines that must be followed by all guests during their stay at the establishment.
Section 29.02
Therefore, the adult client contracting with Mas Caners acknowledges having read and understood all provisions of the Internal Regulations in effect during their stay and commits to strictly complying with and applying them.
Section 29.03
For group bookings, the signatory of the reservation is responsible for ensuring that all adult and minor members of their group comply with the Internal Regulations.
Section 29.04
If a client or a member of their group fails to comply with the Internal Regulations, Mas Caners reserves the right to require the concerned individuals to leave the establishment immediately. In this case, the client will not be entitled to any compensation or refund for amounts already paid due to the termination of the contract. Additionally, the client will remain liable for all services and products consumed up to the date and time of their enforced departure.
Article XXVIII. LANGUE & TRADUCTION
The official language of communication is French. For the convenience of clients, some documents may be translated into foreign languages. While we strive to ensure that these translations are as accurate as possible, some linguistic ambiguities may occur. In the event of any misinterpretation of the translated texts, only the French versions shall be legally binding. The client cannot rely on translations to claim any rights different from those described in the French versions.
Article XXIX. CONSUMER MEDIATOR
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, we offer a consumer mediation service. The designated mediation entity is the Confédération Nationale du Logement (Fédération des Pyrénées-Orientales), HLM Pares – Appt 35, Boulevard Joseph Pares, 66660 Port-Vendres

All disputes arising from purchase and sale transactions conducted under these General Terms and Conditions of Sale (GTC) that have not been resolved amicably between the seller and the client, or through mediation, shall be submitted to the competent courts under common law jurisdiction.
